The Government of Jamaica and the Government of the People's Republic
of China (hereinafter referred as "the two Parties"), out of the common
desire to develop friendly relations and enhance consular ties between the
two countries, have reached the following agreement concerning the
maintenance by Jamaica of the consular post headed by an Honorary Consul
in the Hong Kong Special Administrative Region of the People's Republic of
China:
1. The Government of the People's Republic of China agrees to the
maintenance by the Government of Jamaica of the consular post headed by an
Honorary Consul in the Hong Kong Special Administrative Region of the
People's Republic of China, with the Hong Kong Special Administrative
Region as its consular district.
2. The Honorary Consular Officers shall exercise the consular
functions in accordance with the Vienna Convention on Consular Relations
and the relevant laws and regulations of the Hong Kong Special
Administrative Region of the People's Republic of China, and enjoy the
corresponding privileges and immunities.
3. The Government of the People's Republic of China, in accordance
with its relevant laws and regulations and the Vienna Convention on
Consular Relations, shall accord, the necessary assistance and facilities
to the consular post headed by an Honorary Consul of Jamaica and its
Honorary Consular Officers in the Hong Kong Special Administrative Region
of the People's Republic of China in the exercise of its consular
functions.
4. The two Parties shall handle consular matters between them in a
friendly manner in the spirit of consultation and cooperation, and in
accordance with the Vienna Convention on Consular Relations and
international practice.
5. The Honorary Consular Officers shall be the nationals of either
Party or a third country, but not the stateless, and must be permanent
residents of the Hong Kong Special Administrative Region of the People's
Republic of China.
6. Jamaica shall not appoint any Honorary Consular Officers, once it
has appointed career consular officers to the Hong Kong Special
Administrative Region of the People's Republic of China.
7. The present Agreement shall enter into force on 1997 July 01.
Done in Kingston this 1997 (year) 05 (month) 29 (day) in duplicate in
the Chinese and English languages, both texts being equally authentic.
