The Government of the People's Republic of China and the Government of
the Kingdom of Thailand, out of the common desire to develop friendly
relations and enhance consular relations between the two countries, and in
accordance with Section XI of Annex I of the Joint Declaration of the
Government of the People's Republic of China and the Government of the
United Kingdom of Great Britain and Northern Ireland on the Question of
Hong Kong and Article 157 of the Basic Law of the Hong Kong Special
Administrative Region of the People's Republic of China, which stipulates
that "consular and other official missions established in Hong Kong by
states which have formal diplomatic relations with the People's Republic
of China may be maintained", have reached the following Agreement
concerning the maintenance of the Consulate-General of the Kingdom of
Thailand in the Hong Kong Special Administrative Region of the People's
Republic of China:
Article 1
The Government of the People's Republic of China agrees to the
maintenance by the Government of the Kingdom of Thailand of its
Consulate-General in the Hong Kong Special Administrative Region of the
People's Republic of China, the consular district of which shall be the
Hong Kong Special Administrative Region.
Article 2
The Government of the People's Republic of China agrees that the
Consulate-General of the Kingdom of Thailand in the Hong Kong Special
Administrative Region may, with effect from 20 December 1999 after the
People's Republic of China resumes the exercise of sovereignty over Macao,
performs the consular functions in the Macao Special Administrative
Region.
Article 3
The Government of the People's Republic of China shall, in accordance
with international law and the relevant laws and regulations of the
People's Republic of China, accord all necessary assistance and facilities
to the Consulate-General of the Kingdom of Thailand in the exercise of the
consular functions.
Article 4
Matters concerning the consular relations between the two countries
shall be amicably dealt with in the spirit of cooperation through mutual
consultation in accordance with international law and practice.
Article 5
The present Agreement shall enter into force on 1 July 1997.
Done in duplicate in Beijing on 2 April 1997 in the Chinese, Thai and
English languages, all three texts being equally authentic. In case of
divergence, the English text shall prevail.
