The Government of the People's Republic of China and the Government
of the Union of Myanmar, with a view to further promoting friendly
relations between the two countries and facilitating exchange of visits
by citizens from either country, have, through friendly consultations on
the basis of equality and reciprocity, reached the following agreement
on mutual exemption of visa requirements.
ARTICLE I
Citizens of the People's Republic of China who are holders of valid
diplomatic or service passports of the People's Republic of China, or
who share the same passports with the holders as accompanying persons,
and citizens of the Union of Myanmar who are holders of valid diplomatic
or official passports of the Union of Myanmar, or who share the same
passports of the holders as accompanying persons, shall be exempted from
visa requirements for entry into, exit from or transit through the
territory of the other contracting Party.
The above-mentioned accompanying persons shall be limited to the
spouses and minor children of the passport holders. Save their
preschool-age children, the photos of the accompanying persons should be
attached to the same passports of the holders.
ARTICLE II
Citizens of either contracting Party referred to in Article I of
this Agreement, shall enter into, exit from or transit through ports
open to international travelers of the other contracting Party and go
through necessary formalities in accordance with the relevant
regulations of the latter's competent authorities.
ARTICLE III
Citizens of either contracting Party shall abide by the laws and
regulations in force of the other Party during their stay in its
territory. Citizens of either contracting Party shall, after entering
into the territory of the other Party, go through registration
procedures in accordance with the relevant regulations of the latter's
competent authorities for stay in its territory if such a stay exceeds
thirty days.
ARTICLE IV
Either contracting Party shall obtain prior consent of the other
contracting Party or inform the competent authorities of the other
contracting Party beforehand through diplomatic channels of visits to
the latter by officials of its central government at the rank of vice
minister or above and officers of its armed forces at the rank of
brigadier general or above in their official capacities.
ARTICLE V
This Agreement does not restrict the right of either contracting
Party to prohibit personae non grant or unacceptable citizens of the
other contracting Party from entering its territory or to terminate
their stay in its territory without citing reasons therefor.
ARTICLE VI
Either contracting Party may temporarily suspend this Agreement
partially or wholly on grounds of public order, state security and
public health. However, it shall notify the other contracting Party in
advance of its intention to suspend the Agreement and to subsequently
cancel the suspension through diplomatic channels.
Additional clauses or amendments to the Agreement may be made by
means of exchange of notes by the contracting Parties after
consultation.
ARTICLE VII
The contracting Parties shall timely complete the exchange, through
diplomatic channels, of samples of their passports referred to in
Article I of this Agreement before this Agreement enters into force.
During the period of validity of this Agreement, either contracting
Party, in case of any change of the forms of the above-mentioned
passports, shall inform the other contracting Party through diplomatic
channels thirty days in advance and furnish the latter with samples of
new passports.
ARTICLE VIII
This Agreement shall enter into force on the thirtieth day from the
date of its signature. This present Agreement shall remain valid for an
indefinite period of time. If either contracting Party wishes to
terminate this Agreement, it shall notify the other contracting Party of
its intention in writing through diplomatic channels, and this Agreement
shall cease to be effective on the ninetieth day after the date of
notification.
Done in Yangon on February 3, 1998 in duplicate in Chinese, Myanmar
and English, all texts of this Agreement are equally authentic. In case
of any divergence interpretation, the English text shall prevail.
