The Ministry of Foreign Affairs and Immigration of the Republic of
Vanuatu presents its compliments to the Embassy of the People's Republic
of China in the Republic of Vanuatu, and, on behalf of the Government of
the Republic of Vanuatu, has the honour to confirm that the two sides
have, through friendly consultations, reached the following agreement
concerning the maintenance by the Republic of Vanuatu of the consular post
headed by an honorary consular officer in the Hong Kong Special
Administrative Region of the People's Republic of China:
1. The Government of the People's Republic of China agrees to the
maintenance by the Government of the Republic of Vanuatu of the consular
post headed by an honorary consular officer in the Hong Kong Special
Administrative Region of the People's Republic of China, with the Hong
Kong Special Administrative Region as its consular district.
2. The honorary consular officers shall be the citizens of either
Party or a third country, but not the stateless, and they must be the
permanent residents of the Hong Kong Special Administrative Region of the
People's Republic of China.
3. The Republic of Vanuatu shall not appoint any honorary consular
officers, once it has appointed career consular officers to the Hong Kong
Special Administrative Region.
4. The honorary consular officers shall exercise consular functions in
accordance with Vienna Convention on Consular Relations and the relevant
laws and regulations of the People's Republic of China, and enjoy the
corresponding privileges and immunities.
If the above points receive the confirmation of the Embassy in a note
in reply made on behalf of the Government of the People's Republic of
China, the present note and the return note of the Embassy shall form an
agreement between the two governments and shall enter into force on 1 July
1997.
The Ministry of Foreign Affairs and Immigration of the Republic of
Vanuatu avails itself of this opportunity to renew to the Embassy of the
People's Republic of China the assurances of its highest consideration.
