MEMORANDUM OF UNDERSTANDING ON FISHERY COOPERATION BETWEEN THEGOVERNMENT OF PEOPLE'S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUB-LIC OF CHILE

MEMORANDUM OF UNDERSTANDING ON FISHERY COOPERATION BETWEEN THEGOVERNMENT OF PEOPLE'S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUB-LIC OF CHILE Whole document The Government of the People's Republic of China and the Government of the Republic of Chile (hereinafter referred to as the "Parties"), encouraged by their common will to strengthen their links of amity and their economic and trade relations and to further technological and scientific cooperation on fishery, have agreed as follows: Article I OBJECTIVES 1. The Parties agree to support fishery cooperation activities in different areas on the bases of full reciprocity, equality and mutual benefit.

2. The Parties acknowledge that any cooperation activities should conform to the international conventions related to fishery and to the Parties' domestic laws and regulations on the matter.

3. The Parties agree that all cooperation activities in the field of catch and post-catch technologies, fish trade, fishing products sanitation and quality control and expansion and development of aquacultural resources should be based on the sustainable development of fisheries.

Article II TYPES OF COOPERATION 1. The Parties agree to further the trade of fishing products and services between both countries within the framework of their increasingly open economies.

2. The Parties shall promote the creation of joint ventures between their respective public agencies and the corporate sectors aimed at erecting fish-processing plants, particularly ventures operating on newly-developed fishing resources and/or aquacultural resources.

3. The Parties shall promote the exchange of species fit for culture and aquacultural product technologies, and cooperate in the studies aimed at preventing and healing diseases.

4. The Parties shall strengthen trade as to the construction and sale of fishing vessels, and fishing gear and tackle.

5. The Parties shall promote the exchange of technicians and professionals, fishing statistics and scientific research on fishing and aquacultural resources.

6. The Parties shall cooperate in the development of aquacultures, particularly between small-sized and medium-sized fishermen.

Article III OPERATING METHODS 1. The Parties shall establish a Fishery Cooperation Joint Commission (hereafter "Joint Commission") designed for implementing this Memorandum of Understanding and evaluating the progress made in relation thereto.

2. The Joint Commission shall be composed of an incumbent and an alternate member appointed by each Party.

3. The form of organization and rules of procedure for the Joint Commission shall be defined by consultation of two parties and the Joint Commission shall meet as required to deal with the problems arising in the implementation of this Agreement. It shall also decide on the place and time of the meetings to be held, which shall take place alternatively in both countries.

4. This Memorandum of Understanding shall enter into force upon its signature and have a duration of three years as from such date. It shall be automatically renewed, unless either Party notifies the other of its intention to terminate it.

5. This memorandum is signed in Beijing on November 24th, 1995. Done in duplicate in Spanish, Chinese and English languages, each version being equally authentic.
