PROTOCOL BETWEEN THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINAAND THE GOVERNMENT OF THE FEDERAL REPUBLIC OF NIGERIA FOR COOPERATION ONELECTRIC POWER PROJECTS IN NIGERIA

The Government of the People's Republic of China represented by the
Ministry of Electric Power Industry, Beijing, China (hereinafter referred
to as the "Chinese Side") and the Government of the Federal Republic of
Nigeria represented by the Federal Ministry of Power and Steel, Abuja,
Nigeria (hereinafter referred to as the "Nigeria Side") are desirous of
supporting and ensuring the cooperation in the area of electric power
development in Nigeria.
WHEREAS:
In pursuance of the Memorandum of Understanding signed on Jan. 10th
1996 in Lagos and the Minutes of Meeting on Promotion of Bilateral
Enterprises Cooperation between the Ministry of Electric Power Industry,
the People's Republic of China and the Federal Ministry of Power and
Steel, the Federal Republic of Nigeria signed on May 28, 1996 in Beijing,
extensive deliberations and consultation took place concerning the
cooperation of the two Sides in the implementation of Nigeria power
development projects.
NOW THIS WITNESSETH AS FOLLOWS:
1. The two Sides fully agree to the contents of the Minutes of Meeting
and understand the fact that their enterprises would mutually benefit from
one another through economic and technical cooperation.
2. The two Parties, through friendly consultation, have identified the
following projects for execution and implementation:
(a) Afam power station rehabilitation;
(b) Abuja-Shiroro 330/132KV power transmission line and substation;
(c) Kano-Dutse-Azare 132 KV power transmission line.
3. The Federal Ministry of Power and Steel of Nigeria acknowledges
that North China Power Group/North China Electric Power Design Institute
possesses the technical strength and management experience to undertake
projects in Nigeria. The Chinese side expresses its appreciation for
selecting North China Power Group as its cooperation partner to Nigeria
side.
4. The Nigeria side undertakes to provide funds and construction
conditions stipulated in the Contracts between the two sides. The Chinese
side undertakes to supervise, assist and ensure that North China Power
Group/North China Electric Power Design Institute shall perform
obligations as stipulated in the Contracts with the Federal Government of
Nigeria and provide excellent service and complete the work on schedule.
5. The enterprises of the two Sides shall enter into Contracts with
regards to the specific cooperation projects and submit the Contracts to
the respective Governments for reference. Both Sides shall cooperate on
the basis of equality, mutual benefit with the sole aim of seeking
development and progress for both countries.
IN WITNESS WHEREOF the undersigned, duly authorized thereto by their
respective Governments, have signed this Protocol
Done at ABATA this 12th day of May 1997 in two originals in the
Chinese and English languages, both texts being equally authentic.
