PROVISIONS FOR THE REINSPECTION OF IMPORT AND EXPORT COMMODITIES(FOR TRIAL IMPLEMENTATION)

Article 1
The present Provisions are in accordance with the stipulations of
Article 24 of the Law of the People's Republic of China on the Inspecting
of Import and Export Commodities.
Article 2
Applicants for the inspection of import or export commodities
(hereinafter referred to as applicants), who have objections to the
results of inspection presented by relevant commodity inspection agencies,
may apply to the original commodity inspection agencies or such agencies
at higher levels (up to the State commodity inspection authority).
Article 3
Applicants shall submit applications for reinspection within 15 days
after receiving the results of inspection from the commodity inspection
agencies. They shall complete forms of application for reinspection and
enclose relevant bills and certificates. The date of the mailing of
applications delivered by mail will be regarded as the date of submitting
applications.
Commodity inspection agencies or the State commodity inspection
authority shall approve the applications for reinspection when the
applications are found to meet requirements.
Article 4
Applicants shall keep the commodities submitted for reinspection in
the same packaging, lead sealing, quality, quantity and marking as the
original commodities turned in for inspection and must not put them to use
or change them.
Article 5
Commodity inspection agencies or the State commodity inspection
authority, which accepts applications for reinspection, shall complete the
reinspection and write out certificates on the conclusions of the
reinspection within 30 days after approving the applications. The time for
the reinspection may be extended if its contents and procedures are
complex or if other special circumstances arise, but it must not exceed 70
days and this should be explained to the applicants.
Article 6
Commodity inspection agencies or the State commodity inspection
authority, which accepts the applications for reinspection shall from a
team of specialists for reinspection to do the work.
Article 7
The team of specialists for reinspection shall observe discipline,
handle the job impartially and work independently in accordance with the
regulations.
Article 8
Reinspection shall be conducted in line with the following
procedures:
(1) Examining the applicants' applications for reinspection and other
essentia l papers;
(2) Examining the basis for the original inspection (standards and
methods);
(3) Investigating and examining the procedures and processes of
operation of the original inspection;
(4) Checking the batch, mark or sign, serial number, quality, weight,
quantity, packaging and other exterior conditions of the commodities;
(5) Deciding on the standards for the reinspection and procedures of
operation for the testing as well as the program for obtaining samples for
the reinspection;
(6) Testing the samples;
(7) Holding deliberations and making judgement on the results of the
reinspect ion;
(8) Drawing conclusions on the reinspection and writing out
certificates of th e conclusions on the reinspection.
Article 9
Applicants who have objections to the conclusions on the reinspection
by commodity inspection agencies may apply to the State commodity
inspection authority for further reinspection within 5 days of receiving
the conclusions on the reinspection. The conclusions drawn by the State
commodity inspection authority on the further reinspection shall be final
conclusions.
Article 10
Applicants shall pay fees for the reinspection according to the
regulations.
Article 11
When the results of the reinspection are at variance with those of
the original inspection, the commodity inspection agencies or the State
commodity inspection authority which accepted the applications and
conduced the reinspection shall assess commodity inspection agencies, the
fees for the reinspection shall be charged to the original commodity
inspection agencies.
Article 12
The present regulations came into effect on January 11, 1990.
