Travel Agency Wins in Lawsuit on Abbreviated English Name

The China Youth Travel Service (CYTS) has won a lawsuit to allow it to use its abbreviated English name in an advertisement. The No.1 Intermediate People's Court in Beijing decided to overturn a resolution by the General Administration for Industry and Commerce (GAIC) Trademark Board which turned down an appeal by the CYTS on the dispute. In October 1988, the National Tourism Administration approved the use CYTS as the firm's English abbreviation. In May 2000, the travel agency, one of the three largest in the country, registered CYTS as its trademark in the industries of insurance, car repairs, information, transportation, recreation and catering. The dispute came in January 1996, however, when the company applied to the Trademark Bureau, under the GAIC, for the registration of CYTS as its trademark. The bureau refused the application on the grounds that "CYTS" was too similar to "CITS," the English abbreviation for the China International Travel Service. Later, the Trademark Board rejected CYTS's appeal on the same grounds. The court upheld the plaintiff's claim that CYTS was a justified and reasonable abbreviation for the China Youth Travel Service and that "Y" and "I" are different characters and should not confuse the public. |
